指责 -被控违反规定但尚未进入本政策规定的纪律处分程序的人.

旁观者 —观察犯罪的人, 即将到来的犯罪, 冲突, 潜在的暴力或暴力行为, or conduct that is in violation of rules or policies of ACPHS.

员工 -在报告可能违反本政策的情况时，被卫生及公共服务部雇用的人.

不正当的性行为

Sexual misconduct includes 性侵犯, 非自愿的性行为, 跟踪, 约会暴力, 家庭暴力, 或性剥削, 所有定义如下:

This includes any contact with the breasts, 臀部, 腹股沟, 生殖器, mouth or other bodily orifice of a person upon another person; the touching of another with any of these body parts, without effective consent; sexual intercourse or penetration (anal, 口服, 或阴道)，无论多么轻微, 任何物体或身体部位, by a person upon another person without effective consent ; or other intentional contact of a sexual nature without consent or as a result of 力, 不管是用武力还是威胁, 恐吓, 或胁迫.

性骚扰

Sexual 骚扰ment is a form of sex discrimination and means unwelcome sexual advances, 性要求, and other verbal or physical conduct of a sexual nature when:

2. Submission to or rejection of such conduct by an individual is used as a component of the basis for employment or education-related decisions affecting that individual; or
3. The conduct has the effect of substantially interfering with an individual’s work performance, academic or education-related experience, 或者创造一种吓人的, 充满敌意的, or offensive working or educational environment.

性骚扰的例子包括, 但不限于, 以下, when such acts or behavior come within one of the above definitions:

• Either explicitly or implicitly conditioning any term of employment (e.g., 继续工作, 工资, 评价, 进步, assigned duties or shifts) or educational benefit on the provision of sexual favors;
• touching or grabbing a sexual part of an employee’s body;
• touching or grabbing any part of an employee’s body after that person has indicated, 或者是已知的, that such physical contact was unwelcome;

• displaying or transmitting sexually suggestive pictures, 对象, 漫画, or posters if it is known or should be known that the behavior is unwelcome;

• derogatory or provoking remarks about or relating to an employee’s sex;
• 骚扰ing acts or behavior directed against a person on the basis of his or her sex;

“Consent” for purposes of 不正当的性行为 means “Affirmative Consent.”

“肯定同意”是一种知情, 自愿的, and mutual decision among all participants to engage in sexual activity. Consent can be given by words or actions, 只要这些言语或行为能够明确地表达出参与性行为的意愿. Silence or lack of resistance, in and of itself, does not demonstrate consent. The definition of consent does not vary based upon a participant’s sex, 性取向, 性别认同, 或者性别表达.

The following principles are provided as guidance for the ACPHS community:

• 同意任何一方之间或与任何一方之间的任何性行为或事先两厢情愿的性活动并不一定构成同意任何其他性行为.

• Consent may be initially given but withdrawn at any time.
